The Kimbiz/Kazmin Plot Thickens

Brittany Turner aka Legislative Barbie has compiled quite the dossier on the Kimbiz/Kazmin situation. (Me thinks the unemployed Brittany should seek employment as an investigative journalist.)

I'll let you get the details from her... here's the big take aways:

* Kimbiz/Kazmin may not even be in Americorps. Yikes!

* There are three legal routes to remove Kimbiz/Kazmin from his seat. (Martin, I believe you owe Brittany a dollar.)

* Pete Healey and Brittany are going to try to get the Kimbiz/Kazmin seat declared vacant via the Public Officers Law. If you would like to participate, contact Brittany via her blog.

The outgoing board was supposed to have held their last meeting and take their last actions last night but after going into executive session during last night's meeting for purposes of discussing "the employment history of a particular individual" they later announced that they would have a special last (yes, I said "last" again) meeting on 5/31 - which just happens to be the last day of their terms. One can only speculate about what that will be about because they did not specify. I seriously hope it is not last last minute shenanigans.

Thanks, KT, but your final point isn't quite accurate.

Pete and I are certainly prepared to initiate an application under PBO S. 36, and will certainly welcome others who are interested in signing on. HOWEVER, this is not our preferred approach and we will only be doing this as a last resort.

The most appropriate option is for Brian to resign. This avoids the nastiness and cost of litigation, and also circumvents any additional tensions in the community. It is simply the right thing to do.

If he still refuses to resign, the Village Board (new OR old) ought to commence an action. This is really a Village matter, and should be handled by the governing body. It is outrageous that the old officials were allowed to come and go as they please, and I think there is a significant obligation to begin remedying this trend. As indicated by Kimbiz, people are taking greater and greater liberties with their attendance. We didn't have this problem 10 years ago, and it is really getting out of hand. In addition, if the Village fails to take any action, forcing VoNP residents to do so themselves, it may expose the Village to a similar challenge for failing to uphold it's obligation to the residents of this community. And that would really make a mess of things for everyone.

SO... if Brian refuses to resign, and the Village fails to take any action regarding the vacated seat, yes, we are planning on moving forward. But we are hoping that in the few weeks before we do file, somebody (anybody!) will do the right thing.

PLEASE TAKE NOTICE that a special meeting will be held by the Board of Trustees of the Village of New Paltz on May 31, 2011 at 7:30PM at the New Paltz Village Hall for the Board to enter into executive session to discuss the employment status of particular individuals and upon coming out of executive session, any other lawful business.

This is the posting on the Village Government website announcing the special meeting for the 31st. Let me get this straight:
- They entered into executive session last Wednesday night for the purpose of "discussing the employment history of a particular individual".
- When they left executive session last Wednesday night they voted to hold a special meeting of the Village Board on the last night of their terms of office, Tuesday, May 31st.
- When they announced the agenda for the special meeting, it calls for them to "enter into executive session to discuss the employment history of a particular individual", then afterward to conduct any business they might have.
- Really?!?!?!??!
- No, I mean REALLY?!?!??

It's the Village Board and Deja Vu All Over Again.
